This Privacy Statement (the “Statement”) explains how Resilinc Corporation and its affiliates and subsidiaries (together, “Resilinc,” “we,” “us,” or “our”) collects, stores, uses, and discloses personal information, including when you communicate with us, visit our website, use our services, engage with us on social media, attend our events, or apply to join our team. This Statement addresses specific disclosure requirements from various privacy laws and serves as our “notice at collection.”
Please read this Statement carefully to understand our privacy practices and your rights. We may revise this Statement at any time to enhance transparency or to reflect (1) changes in applicable laws, regulations, or standards, (2) changes to our processing of personal information, or (3) changes to our business operations. We will post the updated Statement here and provide a “Last Updated” date at the top of this page. In some cases, we might provide you with additional notice, for example, by communicating changes to the Statement via email.
- PERSONAL INFORMATION WE PROCESS
Resilinc collects personal information in a number of ways and from different sources, depending on our interactions and the services you use. We collect information directly from you, such as when you contact us, create an account, subscribe to our communications, complete a survey, give us feedback, or apply to join our team. We collect personal information automatically using Cookies and Similar Technologies when you use the services or engage with our content or emails. We collect information about you from others. For example, our customers may provide us your email address to invite you to create an account on our platform. We may also obtain information about you through referrals, from public sources, through social media platforms, or from data brokers. We may also create data or make inferences about you. For example, we may infer your interests based on the content you view or other interactions we have had. The personal information we process includes:
- Identifiers such as your real name, account name, alias, username, postal address, unique personal identifier, unique online identifier, IP address, email address, or other similar identifiers.
- Account Data, which includes the information you supply during the creation of and administration of a Resilinc account and the provision of our services, such as names, phone numbers, and email addresses. Account Data includes Credentials, such as your account password and username, and other personal information Resilinc generates, collects, or creates related to account creation, authentication, administration and use of any Resilinc service.
- Demographic information, such as your industry, market area, general (imprecise) geolocation data, or information about your gender.
- Professional and employment-related information, such as your current employer and job title.
- Education information, such as information about your academic qualifications.
- Commercial information, including prior purchases with us, news about your organization we may learn of through social media platforms or publications, or other public records. Commercial information may also include data and insights that suppliers voluntarily provide about their business to assist customers and create opportunities, including files, communications, assessments, and customer surveys.
- Feedback you may share directly with us, on our website, or social media accounts, including text and photos, as well as any survey data you provide.
- Your preferences, interests, and affiliations, such as your settings, the regions you monitor most, and the languages you use.
- Communications, such as when you send us email or a direct message on another platform.
- Audio, electronic, visual, or similar information, including voicemail recordings, meeting recordings, or photographs taken at events.
- Device data, such as the type of device you operate, its specifications or configuration, information about your web browser, and operating system.
- Internet and electronic network activity, and your interactions, such as the information we automatically collect about your use of the services, using Cookies and Similar Technologies. Such information may include:

- Date and time of your visit to our services and duration of your visit,
- Date and time of your use of our mobile app and the duration of that use,

Some of the information we collect or that you may choose to share may qualify as “sensitive” under certain applicable privacy laws, such as your account credentials, payment card information, your race and ethnicity, your citizenship, your disability or health status, and/or your affiliation to a labor union or other similar organization. We may collect sensitive information incidental to our interactions, as necessary to conduct business, or for other legitimate purposes. For example, you may choose to share information about your disability status to ensure your full participation when you register to attend our events.
Resilinc may process de-identified personal information, which is data we cannot link to a particular individual. Unless allowed under applicable law, we will maintain such information in a de-identified state and will not try to re-identify the individual.
For the purposes described below, we rely on a variety of legal reasons, permissions, or bases to process your personal information. We process your information with your consent, for the performance of a contract we have with you, for compliance purposes or to meet our legal obligations, and for other legitimate interests, such as fraud detection and security, provided that such processing does not outweigh your rights and freedoms.

In carrying out these purposes, we combine information we collect about you from different contexts and sources to provide you with a more seamless and personalized experience, to make informed business decisions, and for other legitimate business purposes.
We may engage in automated decision making, whereby we process your personal information using computation as whole or part of a system to make or execute a decision, facilitate human decision-making, or to profile. This means processing your information, for example, using software code or an algorithm to make a choice without human intervention. We use automated decision making to ensure that marketing materials are tailored to your preferences and to what we think you will be interested in. This does not have any significant effect or legal effect on you. In certain circumstances, it may be possible to infer certain information about you from the result of this decision-making.

Resilinc has reasonable technical, physical, and organizational security measures in place to protect personal information you submit in order to receive the Services. While no computer system or server is completely secure, we believe the measures we implement reduce security problems. Notwithstanding the foregoing, Resilinc cannot guarantee the security of your personal information. When you communicate with Resilinc electronically or otherwise submit your personal information, your communication is not necessarily secure and is subject to all of the risks of communication, including unauthorized entry or use, hardware or software failure, and other factors that may compromise the security of personal information at any time.
- CHILDREN AND MINORS
The Services are not designed for or targeted at children or minors, and Resilinc will never knowingly solicit or collect the personal information of a child or minor. If we discover that we processed the personal information of a child or minor without verifiable parental consent, we will immediately delete such personal information. - YOUR RIGHTS
Privacy and data protection laws provide individuals with specific rights regarding their personal information. Depending on the jurisdiction in which you reside, you may have some or all of the following rights and choices regarding your information:
- To Access or Know: you may have the right to request copies of your personal information and to be informed of how we process your information. For example, you may have the right to be informed or to know:

- To Delete or Erasure: you may have the right to request that we delete or erase your personal information, under certain circumstances. Once we receive and confirm your verifiable consumer request, we will delete (and notify any relevant third parties to delete) your personal information, unless an exception applies. You understand that once deleted, personal information may persist for a reasonable period of time in backup copies but will not be available to others.
- To Opt-out or Restrict Processing: you may have the right to request that we restrict the processing of your personal information, under certain circumstances, or otherwise opt-out of or limit our use of your information. You do not have to be subject to automated decision-making.
- To Object to Processing: you may have the right to object to our processing of your personal information, under certain circumstances.
- Data Portability: you may have the right to request that we transfer the data that we have collected to another organization, or directly to you, under certain conditions.
- Discrimination: you have the right to not be discriminated against for exercising your rights. If you exercise your rights, we will not discriminate against you.
- Automated Decision-making: you may have certain rights regarding our use of automated decision-making, including asking for human involvement in certain automated decisions.

You can exercise your rights in a variety of ways. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and/or confirm the personal information relates to you.
We will confirm receipt of any request to exercise your rights within ten (10) days of receipt and will strive to respond to a verifiable consumer request within thirty (30) days of its receipt. If we require more time, we will inform you of the reason and extension period in writing.
We will deliver our written response by mail or electronically, at your option.
The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

- STORAGE, RETENTION, AND DATA TRANSFERS
Personal information we process may be stored and processed in your region, in the United States, or any other location where Resilinc or our service providers operate.
We consider the following factors when determining how long we retain and store your information:
- Our legal and contractual obligations,
- The purpose for which your information was collected or processed,
- Your requests to delete the information,
- Retention periods in applicable laws and regulation, and
- Our legitimate business purposes. We may retain your data to the extent it is necessary to prevent fraudulent activity, to protect ourselves against liability, allow us to enforce our contractual or other rights, pursue available remedies, and limit any damages we might sustain.
For transfers of personal information from individuals in the European Economic Area (EEA), UK, and Switzerland to countries “not considered adequate” by their respective data protection regulators, to enable their privacy rights and protections to travel with their personal information, we rely on legal mechanisms and the use of other data protection measures. Such legal mechanisms include, but are not limited to, the standard contractual clauses published by the European Commission under Commission Implementing Decision 2021/914, and the International Data Transfer Agreement (IDTA) published by the UK Information Commissioner’s Office. Resilinc complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. Data Privacy Framework, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as administered by the U.S. Department of Commerce. Resilinc has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from (1) the European Union in reliance on the EU-U.S. DPF and (2) the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. Further, Resilinc has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF.
Resilinc takes responsibility for the processing of personal data it receives under the DPF that it subsequently transfers to a third party acting as an agent on our behalf. In such cases, Resilinc remains liable under the DPF if our agent processes such personal information in a manner inconsistent with the DPF, unless we can prove that we are not responsible for the event that caused the damage or harm. If there is any conflict between the terms in this privacy statement and the said DPF Principles, the Principles shall govern.
